US Court Mandates Release of Abrego Garcia from ICE Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.
"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The situation stems from a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to answer alien smuggling charges, he was held in federal detention.
In her order, the court pointed out that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
Background of the Case
The legal challenge center on conflicting claims. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in Tennessee.
Conditions of Release
The court, who was overseeing his challenge to removal in a Maryland district court, determined that he must now comply with the terms of his bond from custody in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
This decision marks a notable development in a complicated legal battle featuring claims of mistaken imprisonment and contested gang affiliations.
